Twenty-seven Scottish church leaders have won a victory for Christian freedoms in the UK, with churches in Scotland being allowed to meet in person once again with immediate effect.

 

In a historic judgment handed down yesterday - believed to be the first successful legal case against Covid regulations in the UK - a judge has ruled that the Scottish government's decision to ban and criminalise gathered worship was both disproportionate and a breach of human rights.

 

In his judgment, Lord Braid states: "I have concluded that the Regulations do constitute a disproportionate interference with the article 9 right of the petitioners and others. As such, they are beyond the legislative competence of the respondents for the reasons set out above."

 

Andrea Williams, chief executive of the Christian Legal Centre, which supported the twenty-seven church leaders, commented: "Over centuries, Christian worship has been regarded as a fundamental freedom in the nations of the United Kingdom. During this pandemic, for the first time in history, our governments chose to criminalise gathered church worship.

 

"We are thankful and relieved that the High Court in Scotland has recognised this dangerous interference with our God-given right to engage in worship for exactly what it is and ruled it unconstitutional. The fundamental principle of freedom has prevailed with a strong dash of good old common sense."

[2] Cancel Culture Cancels Jim Elliott - Wheaton College Removes Plaque Honoring Murdered Missionaries Because of the Word "Savage"

 

In the latest example of “evangelicals” who are following vain secular thinking instead of God’s Word, Wheaton College has removed a plaque commemorating the 1956 martyrdom of five of its graduates because the word “savage” is now considered offensive (“Wheaton College scrubs ‘savage,’ The Spectator, Mar. 17, 2021).

 

The plaque, which was presented in 1957 by the student body class of 1949, stated, “Go and Preach the Gospel ... For the Love of Christ Constraineth. Dedicated to the glory of God and in loving memory of Edward McCully, President of the class of 1949, and James Elliot, likewise an outstanding athlete and leader. Because of the Great Commission, Ed and Jim, together with Nathanael Saint, Roger Youderian, and Peter Fleming, went to the mission field.

 

Willing for ‘anything--anywhere regardless of cost,’ they chose the jungles of Ecuador inhabited by the Auca Indians. For generations all strangers were killed by these savage Indians. After many days of patient preparation and devout prayer, the missionaries made the first friendly contact known to history with the Aucas. On January 8, 1956, the five missionaries were brutally slain--martyrs for the love of God.”

 

The new “woke” Wheaton College is far too worldly wise to use the term “savage” to describe lying murderers of peaceful missionaries, even though it is a perfectly apt description by even the most modern dictionary definition. It means “lacking the restraints normal to civilized human beings, fierce, ferocious, wild, uncultivated, malicious” (Merriam-Webster).

 

Wheaton president Philip Ryken says, “Recently, students, faculty, and staff have expressed concern about language on the plaque that is now recognized as offensive. Specifically, the word ‘savage’ is regarded as pejorative and has been used historically to dehumanize and mistreat indigenous peoples around the world.”

 

But the missionaries were not dehumanizing or mistreating the Aucas; they loved them sacrificially and tried to warn them of eternal judgment and preach the good news of Jesus Christ to them. As for the Aucas of that day, the Bible itself uses terms such as “haters of God, despiteful, proud, boasters, inventors of evil things ... without understanding, covenantbreakers, without natural affection, implacable, unmerciful ... with their tongues they have used deceit; the poison of asps is under their lips: whose mouth is full of cursing and bitterness: their feet are swift to shed blood: Destruction and misery are in their ways ... There is no fear of God before their eyes ... children of disobedience ... children of wrath ... having no hope, and without God in the world” (Romans 1:29-31; 3:13, 14, 15, 16, 18; Ephesians 2:2, 3, 12).

 

The good news is that the college has appointed a “task force to review the wording of the plaque and make a specific recommendation by May 1 for its careful rewording and replacement.” It will be interesting to see what they come up with to describe murdering savages inoffensively.

[3] A Biblical Perspective on the Border Crisis

Illegal immigrants are streaming through our nation's southern border by the thousands. In the two short months of the Biden-Harris Administration, illegal immigration has reached a twenty-year high. Smugglers and human traffickers are pouncing on the opportunity. More than 13,000 children are being detained in facilities after crossing the border from Mexico to the United States. Some as young as six years old entered unaccompanied by a parent.

This crisis is a direct result of the Biden-Harris Administration's dangerous and destructive immigration agenda.

Although radical leftists would say the Bible has no relevance to issues of national debate, the truth is it actually offers balanced wisdom that can light the way forward, not just as individuals, but as a country.

On the one hand, the Bible teaches that we must provide equal justice, protection and compassion for all immigrants who have come to our nation legally. Leviticus 19:33-34 makes this clear:

"And if a stranger sojourn with thee in your land, ye shall not vex him. But the stranger that dwelleth with you shall be unto you as one born among you, and thou shalt love him as thyself; for ye were strangers in the land of Egypt: I am the Lord your God."

On the other hand, the Bible recognizes our inherent power to defend our borders and exercise our sovereignty.

God, "hath made of one blood all nations of men for to dwell on all the face of the earth, and hath determined the times before appointed, and the bounds of their habitation" (Acts 17:26). Borders and walls are found throughout the Bible, from God setting them around the Garden of Eden after the fall (Genesis 3:24), to the establishment of Israel (Exodus 23:31), to the city of New Jerusalem (Revelation 21:10-21). If there will be nations, walls and governments in the new heaven and new earth (Revelation 21:23-24), how much more do we need them in this life!

Individual autonomy and self-defense are unalienable rights that go hand in hand. This is no less true for a nation than for an individual. Every day we secure our private information with passwords and unique usernames. We lock our cars in the parking lot and our front doors at night. In fact, you might even say responsible parents owe a duty to their children to secure the home. Likewise, nations have the natural right and duty to protect the borders of the country. Leaving your doors unlocked exposes you to theft and other crimes. Similarly, national policies that break down boundaries and disrespect national sovereignty, put the lives and property of the citizens at risk. Such laws are a breach of trust between the government and its people.

America can avoid this craziness by following the simple wisdom of the Bible. Let us show compassion and equal justice to all who immigrate here lawfully, while consistently defending our borders against those who seek to come here unlawfully. In the end, it is nothing more than common sense.

[4] Guiyang Renai Reformed Church Under Attack

 

Because of the CCP’s increased surveillance and crackdown on house churches, many of them quietly organize their prayer meetings in hotel rooms. However, there is always the risk that the hotel personnel or others attracted by the monetary rewards paid to those who denounce illegal religious activities report them to the police.

 

This is what happened on March 16 in Guiyang, a prefecture-level city with a population of 4.7 million and the capital of the south-western Guizhou province. The Guiyang Renai Reformed Church organized a prayer meeting in room 1702 of the commercial building part of the Wenzhou Hotel complex, when the police raided the room and arrested several members of the congregation, accusing three local devotees, Chen Jianguo, Li Jinzhi and Li Lin, of having organized the illegal meeting, which was also attended by out-of-town Christians.

A father who has long objected to his minor daughter taking testosterone as part of an experimental gender transition has been jailed in British Columbia for contempt of court.

 

Robert Hoogland was arrested Tuesday after a warrant was issued by a judge earlier this month for telling the public his name and showing his face, according to sources close to the situation. He will reportedly remain in police custody pending a decision on his release to be made at 9:30 a.m. Friday in the British Columbia Supreme Court in Vancouver.

In an historic judgment, today a judge has ruled that the Scottish Ministers' decision to ban and criminalise gathered church worship during the current lockdown was unconstitutional and a disproportionate interference of Article 9 ECHR rights.

The ruling is believed to be the first successful legal case against covid regulations in the UK. 

Handing down judgment, Lord Braid also ruled that online worship is not real Christian worship, stating that it is not for the Scottish Ministers to: "dictate to the petitioners or to the additional party, that, henceforth, or even for the duration of the pandemic, worship is to be conducted on-line. That might be an alternative to worship but it is not worship. At very best for the respondents, in modern parlance, it is worship-lite."

Supported by the Christian Legal Centre, 27 Scottish church leaders, from a range of Christian denominations, had brought the legal action stating that the unprecedented closures were unlawful and breached Human Rights law and the Scottish constitution.

The leaders come from the Free Church of Scotland (Continuing), the Free Church of Scotland, the Church of Scotland, and a number of independent churches.

Their claim came in response to the restrictions outlined by First Minister, Nicola Sturgeon, on Friday 8 January 2021, which made it a criminal offence for churches in the highest tiers, to hold in person services and, for example, to conduct baptisms.

At a full judicial review hearing at the Court of Session in Edinburgh earlier in March, the leaders had sought a declarator (an declaration order) that the restrictions on churches were unlawful and a declarator which would allow people to attend church, should the tier system be reintroduced.

There has been no attempt to close churches in Scotland since the persecution of the Presbyterian church, instituted by the Stuart kings, in the 17th century.

‘Must never happen again’

Responding to the ruling, Rev. Dr William Philip, Senior Minister at the Tron Church in Glasgow, said: “We are very pleased that Lord Braid has recognised how essential gathered church worship is to our communities and to Scotland as a whole.

 “From the outset we have recognised the serious decisions the Scottish Ministers had to take in response to the pandemic. However, its approach to banning and criminalising gathered church worship was clearly an over-reach and disproportionate and if this had gone unchallenged it would have set a very dangerous precedent.

 “However well intentioned, criminalising corporate worship has been both damaging and dangerous for Scotland, and must never happen again.

"There is an urgent need for a message beyond that of just health and safety: a message of hope and salvation, and Jesus Christ is the only hope that dispels all fear, death included. Now is the time as we begin to exit the current lockdown for the church in Scotland, and across the UK, to provide the spiritual leadership that is so desperately needed.”

‘Irreconcilable conflict’

During the judicial review on the 11 and 12 March, Janys Scott QC, representing the 27 Scottish church leaders, argued that the pandemic had highlighted an “irreconcilable conflict” for church leaders between obeying the state and God.  

“Church leaders do not lightly take to law,” Scott told the court. “My note of argument makes no apology for starting with a statement — and that is Jesus is Lord because that encapsulates the issue as far as the petitioners are concerned.

“The Scottish ministers have presented these 27 church leaders and very many more ministers, church elders and ordinary members of congregation with a deep crisis.

“As Christians their primary obedience is to God and not to the state and there is a fundamental obedience in regular communal public worship.

“Regular communal public worship is a central part of the Christian’s life of faith and of the church’s being.

“And to be absolutely clear this is not about buildings — it’s about assembly of congregations; the sacraments of communion and baptism and the ministry between members of a church are integral aspects of expression on what it is to be a Christian and to belong to a Christian church.

“The petitioners would say that faith is a matter of hope in life and in death and it’s more than mere obedience and that it is essential particularly at a time of national crisis.”

Scott argued that the closure of churches is unlawful, criminalises public worship and goes against centuries old practice that churches in Scotland have authority over their own affairs free from state interference.

She accused John Swinney, the Deputy First Minister of holding a “condescending and inaccurate” attitude towards public worship, by treating churches as if they are a “matter of personal welfare or comfort”.

“The Deputy First Minister does not understand”, Scott said. “The primary purpose for worship is not for social or mental well-being. Public worship is a robust central aspect of the practice of the Christian both individually and as a church.

“It is important because that it is no exaggeration to say that over the centuries Christians have died in the defence of the public worship in the church and Christians continue to die in the defence of the public worship in church.

“There is an irreconcilable conflict between the obedience of the Christian church to their God or God and obedience to the state.”

Scott told the court that past legal rulings and the nature of the constitution meant that the state couldn’t interfere with churches.

She also said the European Convention on Human Rights did not allow the Scottish Ministers to take the action of stopping public worship.

“It’s not for the government to question the legitimacy of beliefs or the manner in which they are expressed,” she said. “The petitioners say that public corporate worship is essential to the church — it is of the essence, of the being of the church and that is a matter for them.”

‘Double-Speak’

In her concluding remarks, Scott said: “Without wanting to resort to hyperbole, what is worryingly insidious about the way this has been presented to us politically is, ‘oh no, we haven’t closed your churches’ – and that’s in the face of a regulation that says places of public worship will be closed.

“That’s what the First Minister said and that’s what’s been said in the course of argument for the Scottish Ministers.

“When one starts using double-speak like that one gets to exactly the issue which Article 9 is designed to forfend.

“I’m saying this from the perspective of a group of ministers and church elders who want to defend their right to worship, but it is there as an underlying point which is protected for good reason by the European Convention on Human Rights.”

[2] Church of Jailed Pastor Charged Again for Refusing to Turn People Away

 

The Royal Canadian Mounted Police again charged GraceLife Church in Alberta on Wednesday for refusing to close their doors to congregants and members of the public.

 

According to the Edmonton Journal, on March 4, 2021 the legal counsel for the church was served with a summons to attend Stony Plain provincial court on May 5, 2021.

The church was charged for exceeding fifteen percent allowable capacity for services held on February 21 and 28, 2021 in defiance of the Public Health Act, the Journal noted.

The Vision 2020 Team was formed by RCA General Synod 2018, tasked with exploring future scenarios for the RCA in light of significant divisions among RCA congregants and congregations mostly concerning toleration and affirmation of unbiblical sexual practices.

 

The team initially looked into three future scenarios for the RCA: staying together, radical restructure, and grace-filled separation. After thousands of hours of research, discernment, and feedback, they arrived at a combination of the three.

 

The team released its report and recommendations on June 30, 2020. Read the report.

 

The Vision 2020 report is now scheduled to be considered at the 2021 RCA General Synod (GS) meeting scheduled for October 2021. In preparation for the upcoming report consideration, the GLCC is preparing an overture regarding the report, and the following letter was issued to GLCC members on 12 March 2021 by GLCC President Dan Sewell:

 

An Important Message from the GLCC President,

 

I must apologize that as we’ve been working on the details and quickly disseminating information beforehand, we sent out a “cold” document containing a potential overture to the October GS meeting without a “warm” preface. The plan was to flesh out this overture at our training and prayer gathering on March 16th and then solicit questions prior to actual discussion and potential voting at the official business meeting on the 23rd. This has created some immediate reaction and confusion that I’d like to address in a personal and practical way.

 

We’re simply asking that you prayerfully process and approach this Overture with an open mind. I recognize that in this long period of conflict we’ve become quick to fall into “labeling” everything that comes out as being about “right and left.” I’d suggest we try to avoid assigning the conservative, moderate, liberal, and progressive labels that are so general and often inaccurate. These are “hot” labels that mirror the political landscape we live in. We can better listen to one another and perhaps build trust with one another if we acknowledge that we ourselves resent being labeled, and should therefore be hesitant to label others and their ideas quickly.

 

I will attempt to lay out the rationale for this proposal and what it hopes to accomplish. We’ve seen so many plans and proposals coming from the extreme ends of the conflict that we might miss that this re-visioning of R1 from the 2020 report is not meant to be either divisive or an appeal to the fringes. This is for the middle: People who don’t want their churches voting on human sexuality and wish to retain the current standards and principles of the RCA with integrity.

 

The Overture - an overview:

 

This can be accomplished without a BCO change: Broadly speaking, the formation of Regional Synods is an administrative power of the General Synod. The formation and arrangements of classes is an administrative power of the Regional Synod. We do not need a 2/3 majority or years of wrangling to get this done. It seems unlikely any of the other 2020 recommendations in their current form could get passed.

 

This invites the vast majority in the “Middle Ground” to simply stay put: There is strong evidence that the vast majority of our churches concur with the current RCA standards, creeds and confessions, and statement on human sexuality . Let me be frank: Short of solemnizing same sex marriages and issues of ordination, these standards provide wide latitude for grace filled ministry to broken people by recognizing this means everyone. I’d add that our reformed understanding of Truth and Grace is prohibitive of judgment as we humbly pursue salvation by faith in Christ with all, encouraging them to seek his will in every aspect of life.

 

For GLCC churches who concur with these current standards, no congregational poll, vote, or declaration will become necessary. Unless a church finds itself at odds with these standards and wishes to function in ways inconsistent with current RCA polity, no action is necessary.

This restores integrity to those on both sides of the issue: In the present environment, those churches who have decided differently on these issues and reside in a classis that is supportive of their practices in terms of marriage and ordination simply function in discord with the RCA’s ecclesiastical polity. Others may find themselves in conflict with their own classis in these issues. These would at least be afforded the opportunity to regain integrity within a regional synod that has established an affinity with their theological perception and practice.

 

This would in effect take the R1 concept of affinity classes to its logical conclusion and remove an additional layer of conflict, as each classes would be in a regional synod that is in agreement. For those who concur with RCA polity and those who wish to modify it, each would be afforded the opportunity to pursue their mission with this same level of integrity

 

This is better than 3 Regional Synods. Our Canadian siblings must necessarily remain distinct for legal and practical reasons. But some will ask why we wouldn’t create more affinity synods? Why not 3 or 4? Maybe partition right from center-right, from center-left from left? Not only is this more divisive, you suddenly do need a slew of congregational votes. Whether or not we are able to entice the polar opposites to remain, this split is simply between current RCA policy and those who can no longer agree with it as it stands.

 

While I would suggest the advantages for the disagreeing churches is a lessening of conflict and a return to the integrity of having staled polity, this is most intended as an attractive solution for the many in the middle who wish to turn their attention from this conflict, remain reformed under all of our current standards and confessions, and get back to fruitful mission without complex political procedures.

 

The reality is this split is occurring already. Unmanaged, it will splinter us. This recommendation is to approach it like cutting a diamond in hopes of producing jewels of great value. The other way will be much like smashing a rock, leaving behind only rubble.

 

I do not resonate with the inference in the 2020 report that we need to let churches thinking about leaving leave, and then have a conversation as as family. I find that picture tragic and counter intuitive to the Gospel. This is meant to provide a means to have a reasonable conversation about a viable means to remain “Defined and connected” that may offer hope to some who would decide to remain among us.

 

Friends, I get it! I don't want this. But I refuse to accept the fatal diagnosis for the RCA without pursuing a therapeutic solution. And I personally never want my congregation to be forced to vote on some declaration one way or another to leave or stay or throw down on these issues. Nothing! Period. The goal is to have this administrated with minimal need for legislation and with isolated drama.

 

This will not resolve all the issues of human sexuality, but this truly is a prayerfully crafted solution for moving forward in the good order of the church, and a way to love others through our differences as we turn our attention from the conflict, remain reformed in this best fashion, and get back to fruitful mission.

 

I thank you for your care and concerns for Christ’s mission, and pray that we can arrive at the “win-win” that has been so elusive. What’s not elusive is the victory in Christ that is the result of our faith alone. In this, we all agree.

[5] Critical Race Theory vs. the Bible

 

Critical race theory is a Marxist philosophy and program to tear down all existing biblically-influenced societal, political, and government structures and to replace them with the “new man,” a mythical ideal society. It is “critical” in that it aims to criticize all existing structures. It is a “race” theory in that it divides men into “races” and claims that certain races, particularly the white “race” and those who are aligned with the white “race,” are inherently evil. It is a theory in that it is not a fact. It should be called Critical Race Hypothesis, because a theory at least has some basis in fact, whereas Critical Race Theory has none. A chief tactic is divide and conquer, but it uses any tactic that is effective, including lies, slander, ridicule, theft, threat, repression, terrorism, and murder.

 

It respects no law. It has no love. It takes many forms so as to infiltrate and deceive. It is Black Lives Matter. It is Antifa. It is the 1619 Project. It is leftist college courses. It is historical revisionism in the public schools. It seeks to pit females against males, blacks against whites, mothers against fathers, children against parents, teachers against parents, singles against married, Democrats against Republicans, young against old. It seeks to legalize and empower unrighteousness and moral filthiness. It hates the Bible. It seeks to destroy the traditional family, the New Testament church, home schooling and private education, the Bill of Rights, personal liberty, a stable government of law and order, Republicanism, capitalism, economic stability. Anything that corrupts, harms, or destroys these things is considered good, because that is the immediate goal. It is arrogant and domineering. Critical Race Theory is being taught in Southern Baptist seminaries (“Former ERLC Scholar Says,” Capstone Report, March 13, 2020). Yet Critical Race Theory is contrary to the Bible’s teaching and therefore must be rejected by every Bible believer. The Bible is not a theory; it is the infallible Word of God. Following are some of the biblical truths that contradict Critical Race Theory: All men have one father, Adam; there is only one “race” of men (Acts 17:26). All men are equally sinners before God; none are righteous; none are superior (Romans 3:10-18, 23). God made man male and female (Genesis 1:27). It is an unchangeable biological fact. Homosexuality is a perversion of God’s plan and is destructive to individuals and society (Romans 1:26-28). Men are to respect laws and obey authority (1 Peter 2:13-17). God forbids dishonor of parents, murder, adultery, stealing, lying, and covetousness (Exodus 20:1-17). Men are to love God and love other men as neighbors (Matthew 22:37-40).

[6] Scottish Ministers ‘Crossed Line’ by Criminalising Public Worship Court Told

 

A judge has heard on the first day of a full judicial review hearing that Scottish Ministers ‘crossed a line’ when they made the decision to criminalise public worship and give police maximum powers to enforce it.
 
Supported by the Christian Legal Centre, 27 Scottish church leaders, from a range of Christian denominations, have brought the action stating that the closures are unlawful and continue to breach Human Rights law and the Scottish constitutional law.
 
Janys Scott QC, representing the church leaders who have brought the claim, argued in her submissions that ‘irreparable damage’ had been done to the church leaders and congregations, which is growing in seriousness each day the regulations are in place.
 
Scott QC described it as a ‘rather alarming proposition’ that: ‘Were the church to assemble, it could be required to disperse. Were any members of a congregation to resist, they could potentially be forcibly removed to their homes.’

She described the powers given to the police to enforce these measures as a ‘maximalist approach’ which has violated their human rights and trespassed on the clear separation of powers between the church and state in the Scottish constitution. 
 
The line between civil and spiritual has been crossed, she argued, and the state has exceeded its constitutional authority.
 
She argued that this interference is unlawful, and that the Scottish Ministers lack the constitutional power to make them cease to worship.
 
The freedom of the church to manage its own affairs, as explicitly outlined in Scotland’s constitutional law, she argued means that the:
 
‘Coronavirus Act 2020 cannot authorise regulations which relate to matters within the exclusive jurisdiction of the church, and the Local Levels Regulations and the Closure Regulations are unlawful, in so far as they purport to require the closure of places of worship. By completely preventing the church carrying out essential spiritual and ecclesiastical functions in the form of assembly, communion, baptism and congregational ministry, they trespass into matters that are in law, the sole province of the church.’

Making the argument that Covid-19 affects all parts of the United Kingdom, Mrs. Scott QC pinpointed that no other part of the United Kingdom ‘currently requires places of worship to close. No other part of the United Kingdom criminalises the opening of a place of worship for the purpose of worship, or the attendance at the place of worship for the purpose of worshipping together with others.’
 
Furthermore, she cited a number of successful international cases from the past year which have upheld the right to communal worship, even in the middle of a pandemic.
 
She argued that there is a growing international jurisprudence that banning public worship is disproportionate, unlawful and represents clear government overreach.
 
Despite Nicola Sturgeon announcing this week that gathered worship would be allowed with restrictions from March 26, Mrs. Scott QC argued that there have been no assurances or guarantees that similar restrictions will not be enacted in the future.
 
As a result, in closing her submissions, she called on the court to provide a ‘principle’ judgment in the case. She stated that especially during times of crisis there is a duty to hold governments to their constitutions.
 
She concluded that if a church cannot meet in assembly, it ceases to exist, and called on the court to provide immediate relief. 
 
The church leaders seek a declarator that the closure of churches in Scotland are unlawful, that church closure regulations must be reversed, and that a person may lawfully leave their home to attend a place of worship without fear of prosecution.
 
Andrea Williams, chief executive of the Christian Legal Centre, said: “The church leaders’ case raises a paramount constitutional issue of the church liberties and independence from the state. Never before this pandemic did secular authorities assume the power to ban or permit church services and sacraments. This constitutional principle must be protected for the benefit of present and future generations.
 
“Until this point the Scottish Ministers have had no answers to justify banning church worship. There has been no understanding of what it means to be a Christian.  The Scottish Ministers regulations have placed the church in the same category as a social service and sees it as no different from a betting shop.
 
“This blanket ban must be justified, as currently the reasons are vague, speculative and disproportionate. We look forward to hearing the Scottish government’s submissions tomorrow.”

Pastor Coates was denied bail just one week after the same prison released a convicted child rapist, forcing police to issue a warning to the public to stay vigilant as it's likely the rapist will offend again.

 

The Canadian pastor who was jailed after he refused to turn people away from his Alberta church will remain behind bars until May after being denied bail.

 

Pastor James Coates of GraceLife church will be imprisoned until his May 3-5, 2021 trial after he was arrested two weeks ago and charged under the Public Health Act for violating public health orders, including being over capacity and failing to adhere to social distancing requirements.

[4] 'A Crucial Moment for Church Freedom in Scotland'

 

A judicial review into Scottish ban on gathered worship will start on Thursday 11 May 2021.

 

Tomorrow (Thursday 11 March), the Scottish government will be in court to face a full judicial review hearing over its policy to ban and criminalise gathered worship during the current lockdown.

This is the first time that a judicial review will be heard in the UK which challenges the legality of a government's decision to criminalise in-person, gathered worship.

The decision will not only be important for Christians in Scotland but put a marker down for Christians across the UK.

Supported by the Christian Legal Centre, 27 Scottish church leaders, from a range of Christian denominations, brought forward the legal challenge back in January, following First Minister Nicola Sturgeon's announcement that it would become a criminal offence, in the highest tiers in Scotland, to hold in-person services.

The move to criminalise gathered worship is unprecedented in Scotland, where churches have enjoyed long-established freedoms to conduct their own affairs, free from state interference.

The Scottish government has now announced that churches will be free to open once again from 26 March, in time for Easter. However, this does not negate the legal challenge: the government needs to realise that pastors have always been best placed to make the decision to open or close their churches, depending on the community's needs.

[5] Politicians Hear Evidence Revealing Harms of DIY Home Abortion

 

A cross-party group of politicians from both houses of Parliament were last night (Thursday 4 March) presented with evidence revealing multiple serious incidents of DIY home abortion, including evidence of an average of 36 calls to 999 every month following the taking of abortion pills at home.

Further evidence was presented on the increased demand for the abortion reversal pill, with over 110 calls for help in the last 9 months. The expected average per year is 10-20 calls.

DIY Abortions and Complications: The Evidence

Last night, Thursday 4 March, a coalition of pro-life groups backed an online Parliamentary Briefing hosted by Lord Mackay of Clashfern, DIY Abortions and Complications: The Evidence. The briefing was well-attended by a cross-party group of politicians from both chambers of Parliament and a number of other interested parties.

The briefing was organised in response to the government consultations in England, Scotland and Wales, which have all proposed to make the temporary DIY home abortion policy, introduced nearly a year ago in March 2020, a permanent fixture. The policy was brought in despite assurances from the government that there would be no change to abortion law. After extensive research from multiple parties, which was last night presented to parliamentarians, various groups have now found that the policy raises serious concerns about the safety of women.

Medical risks of pills-by-post

Dr Dermot Kearney, of the Catholic Medical Association, first presented attendees with the concerns for taking the two abortion pills – Mifepristone and Misoprostol – either in clinic or at home. The recognised side effects of using the pills can include haemorrhage, sepsis, sever paid and distress, and psychological trauma. The risk of complication is much higher if the pills are taken after 10 weeks’ gestation. However, gestation cannot be fully assured unless there is proper clinical assessment.

However, Dr Kearney argued that on top of the medical risks already recognised, taking these pills at home is further concerning because it enables coercion and the surreptitious use of drugs to induce an abortion, with no assessment made of the risk of abuse. The lack of a physical assessment also means that gestation cannot be verified and ectopic pregnancies may be missed.

Demands for Abortion Pill Reversal

Dr Kearney also noted that the demands for abortion pill reversal have sky-rocketed since the DIY abortion policy was first introduced.

Abortions have been proven to be reversable, particularly following a number of studies in the USA, following the taking of drugs to counter the effects of Mifepristone. This progesterone therapy is of no greater risk to the baby if it survives the effects of the Mifepristone, and is of no risk to the mother.

Dr Kearney said that abortion pill reversal currently has between a 50-60% success rate in the UK, but greatly depends on how quickly the woman asks for help.

Dr Kearney was one of two medical professionals to set up an Abortion Pill Rescue Service in the UK in April 2020, following the introduction of the DIY home abortion policy. The service is available 24 hours a day – unlike abortion service providers – and has seen over 110 calls for help in the last 9 months.

Systemic underreporting of DIY abortion complications

Kevin Duffy, an independent health consultant and former director at Marie Stopes International (Now MSI Reproductive Choices), then presented findings gathered from a number of freedom of information requests on complications resulting from DIY home abortions.

Neither the Department of Health and Social Care (DHSC) or abortion providers have successfully captured all the data about events that have taken place after abortion pills have been posted. In the case of the DHSC, data collected on the safety of the policy is based solely on information submitted from HSA4 forms.

Between April and June 2020, out of 23,061 medical abortions, the DHSC has recorded just one complication.

However, after making freedom of information inquiries to the CQC and the NHS, it became evident that complications were much more common. FOI requests found that 6 hospitals had reported 69 complications following the taking of abortion pills – this is five times higher than the DHSC states.

The FOI requests also found that an average of 36 calls per month were made to 999 emergency services following the taking of abortion pills, with an average of 20 ambulance responses per month.

Meanwhile, abortion providers do not deem surgical interventions for incomplete abortions to be a ‘complication’.

Between April and June 2020, 208 women were treated surgically in hospital for the removal of retained products of conception.

Mr Duffy urged the DHSC to listen to all of the data, not just the HSA4 forms.

Devastating stories of home abortion

Finally, Rachel McKenzie of Rachel’s Vineyard, which supports women post-abortion, shared the stories of two women who had devastating experiences of DIY home abortions, showing the video of one woman, Kirsty.

Kirsty found out she was pregnant in April 2020, but was coerced by her partner into contacting an abortion provider and taking the pills at home. She shared of how she was too scared to take them at first, and by the time she eventually did, she was past the 9 week 6 day legal limit.

Kirsty said: “The home abortion is made to think you are doing it in the comfort of your own home. But instead, you have the memory of what you have done in your own home forever. My home is no longer my happy safe space, it is the place where I took away my child.”

Miss McKenzie shared how requests for help to Rachel’s Vineyard have increased since the introduction of DIY abortion, with many more women now suffering trauma from having been left to take these pills alone and with no follow up care.

Andrea Williams, chief executive of Christian Concern, one of the groups involved in backing the briefing, commented: “Abortion pills are powerful drugs and the idea that women are receiving them through the post and taking them without proper medical supervision hardly bears thinking about.

“The statistics speak for themselves, yet behind each of these figures are women who have been neglected and failed by the abortion industry.

“Alarmingly, the government is now considering making this dangerous policy permanent – without looking at all the evidence. Women deserve better than this. Women deserve proper care.”
